Event Notes Note (1) The will of Robert Horner of Irstead , made 20 Jan 1773, proved 20 March 1773. In the Name of God Amen, I Robert Horner of Irstead in the County of Norfolk Gentleman being of sound and disposing mind memory and understanding do make ordain publish and declare this to be my last will and testament in manner and form following (that is to say) First I do hereby give and devise unto my Son Leonard Horner his Heirs and Assigns My Manor or Lordship of Irstead with all the rights and Appertenances to the same belonging. And also my Mansion house situate in Irstead aforesaid with all and every the houses outhouses buildings Lands Tenements and Hereditaments thereto belonging or in any wise appertaining situate lying and being in Irstead aforesaid or in any other town parish hamlett or place thereto next near or adjoining. And also all and every other my Messuages Farms Lands Tenements Houses and Hereditaments whatsoever situate lying and being in Irstead aforesaid Neatishead Neatishead and Barton Turf or in any other town parish hamlett or place towns parishes hamletts or places in the said county of Norfolk or elsewhere with all and every the rights members emoluments priviledges advantages and Appertenances whatsoever to all and singular the Hereditaments and premisses aforesaid belonging or in any wise appertaining to have and to hold all and singular the said Manor Lordship Mansion house Messuages Farms Houses Lands Tenements Hereditaments and premisses with their and every of their Appertenances unto the said Leonard Horner and to his Heirs and assigns for ever Charged with and subject to the payment of the several Annuities and sums of Money hereinafter given and bequeathed to Martha my Wife my Son Robert Horner and to my Daughter Deborah Bond and her Son Robert Bond (that is to say) I do give to my dear Wife Martha and her Assigns the sum of Twenty pounds yearly and every year for and during the term of her natural life or so long as she shall continue my Widow to be paid to her clear of all deductions by four equal quarterly payments at the four most Usual Feasts or days of payment in every year (that is to say) the feast of the Nativity of our Lord Christ, the feast of the Annunciation of the blessed Virgin Mary, the feast of Saint John the Baptist and the feast of Saint Michael the Arch-angel the first of the said payment to be made on the first of the said Quarter days that shall happen after my decease Also I do give to my Son Robert Horner a clear yearly Annuity or rent Charge of forty pounds to be paid him yearly and every year for and during the term of his natural life by four even and equal quarterly payments on the four feasts or usual days of payment above mentioned the first payment thereof to be made on such of the said feasts that shall be next after my decease. And my Will and Mind is that in Case that my said Son Robert Horner shall assign or make over the said Annuity or yearly rent Charge to any person that then the same shall cease and determine. And also I do give to my Daughter Deborah Bond a clear yearly sum or rent charge of ten pounds and eight shillings to be paid to her by even and equal weekly payments until her Son Robert Bond shall attain to the age of Twenty one years or in case of his dying under that age then for and during the term of her natural life The first payment thereof to be made on the seventh day next after my decease. And from and after the said Robert Bond shall have attained to the Age of Twenty one years then I will that the said Deborah shall be paid by weekly payments as aforesaid only the clear yearly sum of five pounds and four shillings for and during the term of her natural life. And I do hereby order and direct that the said Annuity or Annuities to be paid to the said Deborah Bond as aforesaid shall not be subject or liable to the debts or control of her present husband and that the same shall be paid into her own hands for her own separate use and that her receipts alone shall be sufficient discharges for the same. And I do hereby give unto the said Robert Bond Son of the said Deborah my Daughter in case he shall live to attain the Age of twenty one years the sum of two hundred pounds to be paid to him in manner and at the times hereinafter mentioned (that is to say) The sum of one hundred pounds part thereof as soon as he shall attain the said Age of twenty one years And the sum of one hundred pounds residue of the said legacy of two hundred pounds immediately after the decease of his said Mother And if the said Annuities Rent Charges or sums of Money herein before mentioned or any or either of them or any part or parts of them any or either of them shall be in arrear or unpaid for the space of thirty days next after the same shall become due and payable as aforesaid and the same shall have been lawfully demanded My will and Mind is that then and in all any or either of the said cases it shall and may be lawfull from time to time and at all times hereafter to and for the person and persons to whom such default of payment shall happen to be made to enter into and upon all and every the said Hereditaments and premisses herein before given and devised to my said son Leonard Horner and his Heirs or into any part thereof in the name of the whole to distrain for all and every such sum and sums of Money that shall be in arrear or unpaid or to have hold and enjoy the said Hereditaments and premisses Charges as aforesaid and the Rents Issues and profits thereof to have receive or take to his her or their own proper use and uses untill such time as he she or they to whom such default shall happen to be made in payment of the said Annuities Rent Charges or sums of Money herein before mentioned or of any or either of them or of any part of them any or either of them shall by and out of the clear rents and profits of the same premisses be fully satisfied and paid all and every such sum and sums of money that shall be so unpaid or in arrear as aforesaid And all Costs Damages Charges and Expenses which he she or they shall bear pay sustain or be put to for or by reason or means of the non-payment thereof. Also I do hereby give and bequeath unto my Son Glean Horner and also to my Daughter Elizabeth Horner the sum of two hundred pounds apiece which legacies I will shall be paid to them the said Glean and Elizabeth by my Executor hereinafter named within six months after my decease or as soon as they the said Glean and Elizabeth shall respectively attain to the Age of twenty one years And I do hereby order and direct that my said Executor shall pay and allow unto the said Glean and Elizabeth Interest for their respective Legacies at and after the rate of five pounds per Centumper (?) Annum untill the same shall become payable as aforesaid to be computed from the time of my decease. And also I do hereby give and bequeath unto my said Son Leonard Horner All the rest residue and remainder of my personal Estate of what nature and kind soever the same be that I shall die possessed of after the payment of the debts that shall be owing by me at the time of my decease and of the said legacies herein before given to the said Glean and Elizabeth and the Charges of my funeral and of the probate of this my Will and other Charges incident thereto And Lastly I do hereby nominate constitute and appoint the said Leonard Horner sole Executor of this my last Will and Testament In Witness I the said Robert Horner the Testator have to this my last Will and Testament contained in six sheets of paper (affixed together at the Top) to the first five thereof set my hand and to this last my hand and seal the Twentieth day of January in the year of our Lord one Thousand seven hundred and seventy three Robert Horner.
